Before using the Immigration Administration App (hereinafter referred to as "the App") developed by
National Immigration Administration (NIA) and its services, please read carefully and fully understand the following
terms and conditions, especially those that exclude or limit liability and separate agreements to provision or use a
certain service. You can choose whether to accept them.
You are not authorized to download, install, or use the App and relevant services until you have read and accepted all
the terms of this Agreement. By downloading, installing, using, or logging in, you are deemed to have read and agreed
to be bound by this Agreement.
I. Scope of Agreement
1.1 Scope of Applicability
The Agreement is regarding your download, installation, use, and login of the App and utilization of relevant
services.
II. Services
2.1 Content
The Services refer to all relevant services (hereinafter referred to as "the Services") provided to the users through
the App.
2.2 Forms
You can use the Services with the App, and NIA will continue to enrich the types of terminal devices through which you
can use the Services. Select the software version compatible with your system for using the Services. Otherwise, you
may not be able to use the Services normally.
2.3 Scope of Permit
All other rights not expressly authorized in this section and elsewhere in this Agreement remain reserved by NIA and
you must obtain separate written permissions from the National Immigration Administration to exercise such rights. The
failure of NIA to exercise any of the foregoing rights shall not constitute a waiver of such rights.
III. User Accounts
For using part of the Services of the App, you need to log into a user account.
IV. Acquiring the App
4.1 You may download the App from the official website of NIA or a third party with NIA's authorization.
4.2 If you acquire the App or an installer with the same name from a third party that is not authorized by NIA, there
is no guarantee that the App will work properly and NIA will not be liable for any loss or damage incurred.
V. Installing and Uninstalling the App
5.1 NIA may develop different versions of the App for different terminal devices. You shall download the appropriate
version compatible with your terminal device.
5.2 After downloading the installer, you need to follow the steps prompted by it for proper installation.
5.3 To provide better and safer services, the App may recommend you to install other apps during the installation, and
you may choose whether to install any of them.
5.4 If you no longer need to use the App or need to install a new version, you may uninstall the App.
VI. App Updates
6.1 To improve the user experience and content of the Services, NIA will constantly develop new types of services and
provide you with software updates (these updates may include software replacements, modifications, function
enhancements, version upgrades, and so on) on an irregular basis.
6.2 The App may enable automatic upgrade and other functions by default. You may choose whether to allow this function
in the App settings.
6.3 To improve the user experience and ensure the security and consistency of the functionality of the Services, NIA
reserves the rights to update the App and to change and restrict partial functionality of the App without notice.
6.4 After the release of a new version, the older ones may no longer be available. NIA does not guarantee the
continued availability of the older versions and corresponding user services of the App. Please verify and download
the latest version.
VII. Personal Information Security
7.1 The personal information security of users is a fundamental principle and NIA will take reasonable measures to
protect such information. Except for the circumstances prescribed by laws and regulations, NIA will not disclose the
personal information of any user to any third party without his/her permission. Professional encryption for the
storage and transmission of relevant information is adopted by NIA to ensure the security of users' personal
information.
7.2 In the process of logging in to use the Service, you may need to fill in some necessary information. If the
national laws and regulations or policies of the People's Republic of China have special provisions, you need to fill
in the information regarding your real identity. If you provide incomplete information, you will not be able to use
the Services or will be restricted during usage.
7.3 Generally, you may browse and modify the information you submit at any time, but for security and identification
purposes, you may not be able to modify the initial identification information and other verification information
provided at the time of registration.
7.4 NIA will apply a variety of security technologies and procedures to establish a sound management system to protect
your personal information from unauthorized access, use, or disclosure.
VIII. User Code of Conduct
8.1 Note to Users
8.1.1 You fully understand and agree that when using a certain service, it may require relevant permission, access and
information from your terminal device in order to achieve the corresponding functions, and some services may require
separate protocols or regulations. Please read the relevant aforementioned agreements and rules carefully before using
them.
8.1.2 NIA is entitled to present information in or through the Services, including but not limited to news and
publicity information, which may take the forms of system messages, pop-ups, etc.
8.1.3 You may choose not to provide some information or cancel the collection of some information in the settings.
This may lead to the unavailability of relevant service functions.
8.1.4 You understand and agree that NIA is committed to protecting the security of data storage in the App and the
Services for you. However, NIA cannot ensure full security in several circumstances including but not limited to the
ones stated below:
(1) NIA takes no responsibility for the deletion or storage failure of data related to you in the App and Services.
(2) NIA is entitled to determine the valid duration of data storage in the App and the Services and the maximum data
storage space on the server. You are advised to make backup copies of the data you need from the App and the Services.
If the parties agree otherwise, the corresponding agreement shall be implemented.
(3) If you stop using the App and the Services or if the Services are terminated or canceled, NIA can permanently
delete your data from the server. NIA is not obligated to return any data to you after your service has been
discontinued, terminated, or canceled.
8.1.5 When using the Services, the content may vary depending on the version of the App. You understand and agree
that:
When you use certain versions of the App to open or access the relevant text-pages of the developed application
distribution products or functions, the version information, installation location, size, and other necessary
information of the app already installed on your terminal device, may be used depending on the actual version
provided, to better provide you with smart services such as application upgrade tips on your terminal device.
8.2 Prohibitions
You may not use the Services to engage in any of the following activities, including, but not limited to:
(1) Publication, transmission, dissemination, or storage of content that violates the laws or regulations of the
People's Republic of China or endangers national security, national unity, social stability, public order or morality,
social morality, as well as insulting, defamatory, pornographic and violent content;
(2) Publication, transmission, dissemination, or storage of content that infringes on the legal rights of others, such
as reputation, portrait, intellectual property, trade secret, or other legitimate rights;
(3) Falsification of facts or concealment of the truth in order to mislead or deceive others.
(4) Publication, transmission, or dissemination of advertising information or spam;
(5) Engagement in other violations of laws, regulations, or policies of the People's Republic of China, or undermining
public order or morality, or social morality.
8.3 Forbidden Activities of Users
Unless permitted by law or the National Immigration Administration with written permission, you shall not get involved
in any of the following:
(1) Removal of information regarding copyright on the App or its copies;
(2) Reverse engineering, disassembly, decompilation, or other attempts to discover the source code of the App.
(3) Activities to use, rent, lend, copy, modify, link, reproduce, compile, release, publish, or establish mirror sites
of the content of which NIA owns intellectual property rights;
(4) Activities to copy, modify, add, delete, hook up to run, or create any derivative works of the App or the data
released into the memory of any terminal device during the operation of the App, the interaction data between the
client and the server during the operation of the App, or the system data necessary for the operation of the App, in
the form of, but not limited to, using plug-ins, or third-party tools/services not authorized by the National
Immigration Administration to access the App and related systems.
(5) Activities to add, delete, change the functions or operating effects of the App by modifying or falsifying the
instructions or data of the App operation, or activities to operate or disseminate to the public the App or methods
used for such purposes, whether or not these acts are for commercial purposes;
(6) Logging or using the App and the Services through third-party software, plug-ins, add-ons, or systems that are not
developed or authorized by NIA, or creating, distributing, or disseminating the above-mentioned tools;
(7) Interfering with the App, its components, modules, or data, among others by yourself, authorizing others, or using
third-party software.
(8) Other acts that are not expressly authorized by NIA.
User Responsibilities
You fully understand and agree that you are responsible for all actions taken under your account, any content posted
by you, and the consequences thereof. You shall exercise your own judgment regarding the content to which you are
exposed when using the Services and assume all risks arising from the use of the content, including the risks arising
from reliance on the accuracy, completeness, or usefulness of the content. NIA cannot and will not be liable for any
loss or damage arising from the risks mentioned above.
Breach Handling
If NIA finds or receives reports from others that you have violated this Agreement, it is entitled to remove or
obscure relevant content at any time without notice and take measures including but not limited to suspending or
terminating your account and your accessibility of part or all of the Services, and pursuing legal responsibility.
Handling of Damage to Third Parties
You shall be independently liable for any third party damage as a result of your breach of the Agreement. Where any
damage is caused for NIA out of your violations, you shall compensate for any damage suffered as a result.
IX. Products or Services from Third Parties
When you use the products or services provided by third parties on the platform, you shall comply with the user
agreement of the third party in addition to the agreement herein. NIA and the third party are independently
responsible for any disputes that may arise to the extent provided by law and agreed upon.
When users use the App or request specific services from NIA, the App may call upon third-party systems or support
user access through third parties, and the results of use or access are provided by such third parties (including but
not limited to the services and content provided by third parties that you go to through the Services and content
accessed by third parties through NIA's open platform, etc.). Therefore, NIA cannot guarantee the security, accuracy,
validity, or other uncertain risks of the services and content provided by third parties, and you shall bear the
related responsibilities.
X. Statement on Intellectual Property Rights
NIA is the owner of the intellectual property rights of this App. All copyrights, trademarks, patents, trade secrets,
and other intellectual property rights of the App and all information content related to the App (including but not
limited to words, pictures, audio, video, charts, interface design, layout framework, relevant data or electronic
documents) are protected by the laws and regulations of the People's Republic of China and relevant international
treaties, and NIA enjoys all the above-mentioned intellectual property rights, except the rights that relevant rights
holders shall enjoy according to law.
You shall not, or permit any third party to implement, use, or transfer any of the above-mentioned intellectual
property rights for any commercial or non-commercial purpose without prior written consent from NIA or the relevant
rights owners.
XI. Responsibilities for Terminal Device Security
You understand and agree that the App or the Services, sharing similarities to most Internet apps and services, may be
affected by a variety of factors (including but not limited to the user-related issues, quality of network services,
and social environment). The App or the Services may also be interfered with by various security issues (including but
not limited to illegal use of users' information by others to cause harassment in real life. Other software downloaded
and installed or websites visited by users may contain viruses, Trojan horses, or other malware, which may endanger
the security of information and data on your terminal devices and affect the normal use of the App or the Services).
Therefore, you shall enhance your awareness of information security and protection of personal information, and pay
attention to the protection of your password to avoid potential losses.
You shall not produce, publish, use, or disseminate any malware which steals account information and the privacy or
property of others.
NIA and you share the responsibility of maintaining the security and normal use of the App. NIA will reasonably and
carefully take necessary technical measures to protect the information and data security of your terminal devices
according to relevant industry standards. You acknowledge and agree that NIA cannot offer a full guarantee in this
regard.
You shall not, in any case, trust any online information that is related to property, such as offering loans or
requests for passwords. Please make sure to verify the identity of the person involved in any operation related to
property. In addition, please always pay attention to tips on preventing fraudulent crimes.
XII. Software or Technology from Third Parties
The App may involve the use of third-party software or technologies (including open source and code from the public
domain that may be used in the App, hereinafter), and such use has been granted legal authorization.
If any third-party software or technologies are adopted in the App, NIA will display relevant agreements or documents
in accordance with relevant laws and regulations through annexes of this Agreement or a package within the
installation file of the App, or the relevant agreements or documents will be displayed in the "App License
Agreement", "License Agreement" or "Open Source License", etc. The foregoing agreements and documents presented
through different forms constitute an integral part of this Agreement and shall share the same legal effect. You shall
comply with all requirements mentioned. If you do not comply, the third party or competent state authority may bring
lawsuits, impose fines or other sanctions against you, and may request assistance from NIA. You shall be solely liable
for all relevant legal liabilities.
XIII. Other
By using the App or the Services, you are deemed to have read and agreed to be bound by this Agreement. NIA reserves
the right to modify the terms of this Agreement when necessary. You can review the terms of the Agreement in the
latest version of the App or the Services. If you continue to use the App and the Services after the terms of this
Agreement have been changed, you are deemed to have accepted the amended agreement. If you disagree with the modified
agreement, you shall stop using the App.
The laws of the Chinese mainland (excluding Conflict of Laws) shall apply to the establishment, effectiveness,
performance, interpretation, and dispute resolution of this Agreement.
Any disputes between you and NIA shall first be resolved through friendly negotiation. If negotiation fails, you agree
to submit disputes to the People's Court(s) with jurisdiction in the place where the Agreement is signed.
The headings of all terms in the Agreement are only for the convenience of readers and do not have any actual meaning
and shall not be taken as a legal basis in interpreting the meaning of the Agreement.
The terms of this Agreement shall be partially invalid or unenforceable for whatever reason, and the remaining terms
shall remain valid and binding on the parties.
The Agreement may be drafted in different languages, including Chinese, English, and other languages. In case of any
inconsistency and discrepancy between different language versions, the Chinese version shall prevail.
